Service Provided.
BeepMe Las Vegas, Inc. agrees to provide Subscriber a news
service through wireless paging. This news information is
sent through a nationwide paging carrier.

Paging Carrier.
This is the airtime provider that allows us to send our
data over a wireless paging system. Service is available
in most metropolitan areas and is subject to interferences
due to factors beyond our control. |
|
News Providers.
We receive news information from these providers. Scores,
Injuries, Weather, Lines, and News Stories. At anytime the
information can change with out notice.
|
|
Equipment.
The Purchase of an alphanumeric pager is required for you
to receive the wireless News information. This equipment
if owned by you. We have a 30-day warranty on all pagers
that are sold new or used. (Excluding Physical Damage)

Subscriber Equipment.
Nothing in this Agreement shall be deemed to require the
maintenance and/or service of any subscriber-owned
equipment. |

Subscriber Capacity.
This is our Terms of Service and becomes a contract when
subscriber becomes a customer. It is understood and agreed
that subscriber is of legal age and has read and clearly
understands all of the terms of service. |

Service Fees.
Subscriber shall pay BeepMe Las Vegas, Inc. the fees set
forth in the Agreement. All fees are subject to change by
BeepMe Las Vegas, Inc. upon notice to Subscriber. |

Billing.
Subscriber is responsible for providing BeepMe Las Vegas,
Inc. with current billing address and a daytime telephone
number where subscriber can be reached. Invoices are due
and payable on the 25th day of the previous month. A late
charge of $ 10.00 will be charged on the 1st on the month.

Service Activation.
Subscriber may reactivate service by calling BeepMe Las
Vegas, Inc. and requesting reactivation. Subscriber shall
be held responsible for payment of any and all monies due
on the account before reactivation is performed. Monthly
fees will be charged until BeepMe Las Vegas, Inc. receives
a written cancellation notice (see Service Disconnection)

Service Disconnection.
Subscriber is required to provide a written notice to
BeepMe Las Vegas, Inc. requesting service disconnection.
Such notice is required on or before the 1st day of the
month disconnection is desired. Subscriber shall beheld
responsible for any and all monies due prior to said
disconnection date. Written cancellation notice is
required from all subscribers even if you’ve prepaid in
advance for service (i.e. yearly subscription, bi-yearly
subscription, etc.) A $25.00 service charge will be
implemented for all accounts disconnected for non-payment.
This fee is nonnegotiable. Disconnection will occur for
non-payment for any account over 30 days past due. All
accounts will be forwarded to a Collection Agency if
payment is not made within 60 days. |

Limitation of Liability.
Notwithstanding anything contained herein, BeepMe Las
Vegas, Inc. nonperformance hereunder shall be excused if
caused by equipment failure, acts of God, strikes,
equipment of facilities shortages or other cause beyond
BeepMe Las Vegas, Inc.’s control. In addition, the
liability, if any, of BeepMe Las Vegas, Inc. for any
mistake, omission, interruption, delay error, defect or
other failure in its operation of service furnished, or in
the transmission thereof over the facilities used in
furnishing service hereunder, shall in no event exceed the
amount of BeepMe Las Vegas, Inc. Subscriber agrees to
indemnify and hold BeepMe Las Vegas, Inc., its officers,
employees, agents and affiliates harmless from and against
any and all costs, expenses, acts, actions, or claims
(including reasonable attorney’s fees and costs to
establish the applicability of this paragraph) by
subscribers, customers, former customers, or third parties
arising out of or in connection with the activities
contemplated by this Agreement, even if occasioned by the
sole negligence of BeepMe Las Vegas, Inc. |

Governing Law.
This Agreement, including all matters relating to the
validity, construction, performance and enforcement
thereof, shall be governed by the Laws of the State of
BeepMe Las Vegas, Inc.’s principal operations. |
|
Not for Resale.
Subscribers shall represent and warrant to BeepMe Las
Vegas, Inc. that they shall not reproduce, publish, or
distribute the information in any format, in whole or in
part for sale or commercial use. |
